2 | 5 | According to Rule 4, the local, Foreign private and non-governmental organizations must submit the following documents together with the application for permission to establish: (a) number of children under three years of age; (b) Kindergarten building, type and size, number and size of daycare rooms, proof of ownership and a copy or photograph of such documents; (c) address of the location of the daycare center building, contact phone number, fax number and email address; (d) nursery supplies for early childhood, list of furniture and teaching aids; (e) responsible principal and teacher to be nurtured, the age of each teacher and their education certificate of completion of an early childhood education course under the age of three recognized by the Department of Social Welfare and recognized as appropriate and copy of Citizenship Verification Card (if the person is a foreigner, country, citizen, name, passport number and visa) (f) number of teachers and staff and recommendations from the relevant health department that they are healthy and free from infectious diseases; (g) curriculum and weekly teaching schedule; (h) recommendation of the relevant ward or village administrator and township administrator; (i) additional recommendation of the relevant District Social Welfare Office established and opened by the Ministry; (j) undertaking when the permit is approved for the acknowledgment that the rules will be followed such as, technical assistance provided by the Central Supervisory Board upon establishment permit, taking section, supervision and guidance by the rules and regulations issued by Law. |

3 | 11 | The person authorized to establish a daycare center: (a) shall appoint a responsible headmaster who is over 25 years old and has a degree from a government-recognized university or a person with a diploma in child skills or with a qualification accepted by the Department of Social Welfare will only be appointed; (b) the principal in charge appointed under sub-rule (a) must have successfully completed any training course for children under three years of age who is supervised and recognized by the Department of Social Welfare. In addition, at least one teacher must have successfully completed one of these nurturing courses; (c) early childhood care should be provided in accordance with the separate instructions in addition to the guidelines for raising children under three years of age; (d) bed space, playgrounds and facilities must be provided for the children under one year of age and appropriate facilities for the children between one year of age and three years of age as well; (e) one teacher for every three children under two years of age and there should be one teacher for every six children between the ages of two and three; (f) the building to be used as a daycare center shall have an average area of at least 18 square feet for each of early childhood children; (g) shall comply with the conditions contained in the establishment permit; (h) in addition to the requirements from sub-rules (a) to (g), it shall also comply with the provisions prescribed from time to time by the Ministry and the Department of Social Welfare. |

4 | 16 | Five or more children under the age of three and under the age of five and children who have not yet been enrolled in primary school after the age of five shall be provided with physical education, wisdom, character, social relations if a local or foreign non-governmental organization (NGO) wants to establish a pre-primary school in order to develop all-round emotional development and develop good lifelong habits, it must comply with the requirements for the establishment of a pre-primary school under Section 18 of the Law: (a) in the case of a local private and non-governmental organization, the application shall be submitted to the Region or State Social Welfare Office in the application form (g) so that it can proceed as required for the establishment permit issued by the relevant Region or State Supervision Board by paying 200 Kyats of office tax stamp with the application; (b) in the case of a foreign private and non-governmental organization, the application shall be submitted to the Region or State Social Welfare Office in the application form (h) for further approval as required by the Central Supervision Committee through the relevant Region or State Supervision Board and the Department of Social Welfare by paying 300 Kyats of office tax stamp with the application. |

6 | 19 | The Region or State Supervision Committee shall: (a) scrutinized either the issuance of a permit or denied for the local private and non-governmental organizations which made an application for a permit to establish a pre-primary school under sub-rule (a) and a submission under Rule 18 of the Region or State Social Welfare Office; (b) issue the establishment permit in Form (i) in accordance with the term and conditions prescribed for the pre-school of the Central Supervisory Board if permitted under sub-rule (a); (c) before issuing the establishment permit under sub-rule (b), the registration fee prescribed by the Central or State Government on the period prescribed by the Central Supervision Committee and the following fees for the establishment permit shall be paid according to the number of early childhood children: (i) fees for the establishment permit for 5 to 19 early childhood children; (ii) fees for the establishment permit for 20 to 49 early childhood children; (iii) fees for the establishment permit for 50 to 99 early childhood children; (iv) fees for establishment permit for 100 or more early childhood children. (d) the registration fee and fee for the establishment permit prescribed under sub-rule (c) may be exempted for the voluntary or self-established pre-primary schools which are establishing not for commercial purpose. |

7 | 23 | The person who has been granted permission to establish a pre-primary school shall: (a) appoint the responsible headmaster who is above 25 years old and has a degree from a government-recognized university or only those with a diploma in pedagogy or with a qualification accepted by the Department of Social Welfare should be appointed. (b) appoint the responsible principal under sub-rule (a) by successfully completing any pre-primary teacher training course which is supervised and recognized by the Department of Social Welfare. In addition, among the teachers, at least one teacher must have successfully completed one of these pre-primary teacher training courses. (c) arrange for preschool children raising in accordance with specific instructions, comprehensive development curriculum for pre-primary school children and teacher's guidebook; (d) accommodate one teacher for every 15 children between the ages of three and five and above. (e) have an average area of at least 18 square feet for each and every pre-primary children in the building where the pre-primary school will be located; (f) abide by the terms of the establishment permit; (g) also comply with the provisions prescribed from time to time by the Department of Social Welfare in addition to the requirements from sub-rules (a) to (f). |

8 | 24 | Holders of local pre-school permits shall: (a) if the establishment is to continue after the expiration of the establishment permit, submit the application form (k) together with the documents prescribed under Rule 5 to the Region or State Supervision Board at least 60 days before the expiration of the period for the renewal of the establishment permit by paying 200 Kyats of office tax stamp with the application; (b) pay the fee for the renewal of the establishment permit as per Rule 19 for the period of establishment permit in accordance with the fee prescribed in sub-rule (c). |

9 | 26 | The person from abroad who has received permission to establish a pre-primary school shall: (a) if the establishment permit is to be re-established after the expiration of the establishment permit, submit the application form (l) together with the documents prescribed under Rule 5 to the Central Supervision Committee, through the relevant Region or State Supervision Board and the Department of Social Welfare, at least 60 days before the expiration of the permit to proceed as necessary by paying 300 Kyats of office tax stamp with the application.
