Amending Law


The Pyithu Hluttaw enacted the following law.

Chapter 1
Title and Definition

1. This shall be called the Road and Bridge Use Law.

2. The following expressions contained in this Law shall have the meanings given herein:

(a) Road means the road and the boundary of the road and the road or the road and the road which is determined by the notification letter issued by the relevant Ministry for the purpose of this Law;

(b) Bridge means the bridge designated by the notification letter by the relevant Ministry for the purpose of this Law;

(c) Vehicle means the vehicle designated by the notification letter issued by the relevant Ministry for the purpose of this Law;

(d) User means a person driving or walking on the road and bridge prescribed by this relevant Ministry or by other means;

(e) Use means the use of roads and bridges in any way prescribed by the relevant Ministry;

(f) Utilization fee means the fee paid for the use of the road and bridge in any way prescribed by the relevant Ministry;

(g) Supervisor means a person of the organization or other organization designated by the relevant Ministry to supervise the collection of usage fee;

(h) Collector means the person assigned by the supervisor to collect the usage fee.

Chapter (2)
Responsibilities and Powers

3. The relevant Ministry shall issue an order:

(a) determining the road and bridge where the usage fee will be collected;

(b) a rate may be set for collection of usage fee;

(c) determining the type of vehicle to be charged;

(d) giving exemption from usage fee.

4. Supervisor:

(a) shall have responsibility for supervising the collection of usage fee at the prescribed rate;

(b) shall supervise that no one collects the usage fee except the person authorized to collect it.

5. The toll collector shall collect the usage fee at the rate to the driver or the user set by the Ministry.

Chapter 3
Prohibition

6. No one is allowed to collect the usage fee except the person who has the right to collect it.

7. The collector shall not charge more than the prescribed usage rate.

Chapter 4
Offenses and penalties

8. If the driver or user fails to pay the usage fee, the usage fee and fine shall be paid according to the method prescribed by the relevant Ministry.

9. Whoever violates the provisions of section 6. If convicted of attempting to commit or aiding and abetting, he shall be punished with imprisonment for a term not exceeding six months or a fine of not less than 50,000 kyats and not more than 300,000 kyats or both punishments must be imposed.

10. Whoever violates the provision of section 7. If convicted of attempting to commit or aiding and abetting, he shall be punished with imprisonment for a term not exceeding three months or a fine of not less than one hundred thousand kyats and not more than five hundred thousand kyats or both punishments must be imposed.

11. Whoever is convicted of violating the provision of section 8 shall be punished with imprisonment for a term not exceeding one month or a fine of not less than 50,000 kyats and not more than 100,000 kyats or both punishments must be imposed.

Chapter (5)
General

12. The relevant ministry shall announce the usage rates, fines for offenses and punishments to know the public.

13. In implementing the provisions of this law:

(a) the Ministry of Construction shall issue the necessary rules and regulations with the approval of the Union Government;

(b) the Ministry of Construction shall issue the required notification, order, directive and procedures;

(c) the Road Department may issue necessary orders and directives.

14. The Tolls Act, 1851 was repealed by this Law.
